This book is a philosophical-historical examination of the influence of the knowledge of China imparted by the Jesuits on the thinking of the German Enlightenment in the 18th century. It is not primarily concerned with a comprehensive reconstruction of the philosophy of the thinkers discussed, but rather with the political and intellectual contextualisation of a line of thought that recognised the practical philosophy and state organisation of China as different from that of Europe, while equal to it and in some respects superior to it. This challenged the claim of theology that Christian revelation alone provided access to truth. The volume analyses the opposition to this line of thought, especially on the part of Protestant orthodoxy. It argues that in the German Enlightenment of the 18th century, the possibility emerged to conceive philosophy on the basis of reason as a phenomenon not limited to Europe but as a path followed under different conditions in China.

Kant denied biology the status of proper science, yet his account of the organism has received much attention from both philosophical and historical perspectives. This book argues that Kant's influence on biology in the British Isles is in part due to misunderstandings of his philosophy. Highlighting these misunderstandings exposes how Kant influenced various aspects of scientific method, despite the underlying incompatibility between transcendental idealism and scientific naturalism. This book raises criticism against scientific naturalism as it demonstrates how some concepts that are central to biology have been historically justified in ways that are incompatible with naturalism. Approaching current issues in philosophy of biology from a Kantian orientation offers new perspectives to debates including our knowledge of laws of nature, the unity of science, and our understanding of organisms. Moreover, new avenues are forged to demonstrate the benefits of adopting Kant-inspired approaches to issues in contemporary philosophy of science.

Der Band dokumentiert die Niederschriften der von der Zentralen Stelle ausgerichteten Tagungen der in der Bundesrepublik mit der Strafverfolgung von NS-Verbrechen befassten Staatsanwaelte von 1964-1970 und von 1988-1995. Die Zentrale Stelle (zunaechst unter der Leitung von Erwin Schuele und anschliessend von Adalbert Rueckerl) wurde auf Initiative Baden-Wuerttembergs 1958 begruendet und hat die Aufgabe, die Vorermittlungen zu fuehren wegen solcher Verbrechen, die waehrend der nationalsozialistischen Herrschaft von den Gewalthabern des Dritten Reichs ausserhalb der eigentlichen Kriegshandlungen begangen worden sind (seit Ende 1964 nicht mehr auf die Verbrechen im Ausland beschraenkt). Wichtige Themen der ueber 60 Referate und der Diskussionen sind: Zusammenarbeit der Zentr. Stelle mit den Staatsanwaltschaften, Befehlsnotstand, Abgrenzung von Taeterschaft und Teilnahme, Strafmass in NS-Verbrechen, Rechtshilfeverkehr mit dem Ausland, Zeugenvernehmungen in Israel und den USA, Zeugenbefragung vor Schwurgerichten, Analyse eines grossen NS-Prozesses, archivalische Quellen. Die Geschichte der Justizverwaltung, die den Justizministerien sowie den Gerichtspraesidenten und den Generalstaatsanwaelten zusteht, ist bisher, von der NS-Zeit abgesehen, fuer das 20. Jahrhundert nur selten Gegenstand besonderer rechtsgeschichtlicher Darstellungen gewesen. Eine wichtige Quelle fuer die Justizverwaltungsgeschichte bilden die in der Edition wiedergegebenen Protokolle der Beratungen der Justizministerien Bayerns und Preussens mit den Praesidenten der Oberlandesgerichte und den Generalstaatsanwaelten von 1917 bis 1934. Ferner werden wiedergegeben die Protokolle von vier Tagungen der Landesjustizminister von 1933-1934. There were political and philosophical controversies regarding science and technology in this environment between spiritualists (humanists) and positivists (scientists).. Power and knowledge were intertwined in these controversies. Another objective of the book is to show that controversies can be seen as a dispute between two cultures between those in favor of science and technology and those in favor of philosophy and the humanities. Their continuous arguments articulated a third culture based on an intertwining of power and knowledge. This articulation had an implicit dimension in which philosophy, science, and technology had to interact to enrich the political potential of the human experience of thinking. They were able to grasp a mix or a synthesis that conceptualized the power of a metaphysical artifact in which philosophy, science, and technology belong to the same culture, where politics helps invite dialogue between different cultural, religious, and political perspectives.

Obgleich die Beschaeftigung mit der ?ratihabitio?, der Genehmigung, auf eine lange Tradition in der Rechtswissenschaft zurueckblickt, fehlte es bislang an einer neueren deutschsprachigen Untersuchung. Die vorliegende Schrift beleuchtet anhand von Quellenuntersuchungen ausgewaehlte dogmatische Fragen zur ?ratihabitio? im klassischen roemischen Recht und zeichnet dabei den Gedankengang der klassischen Juristen von einem tatsaechlichen ≫Billigen≪ bis hin zu einer rechtlichen Anerkennung einer fremden Handlung nach. Es zeigt sich, dass die Rechtsfigur der ?ratihabitio? dem Rechtsinstitut der Genehmigung nach Paragr. 184 Abs. 1 BGB nahesteht und ihr doch fremd ist. Von Bedeutung ist die ?ratihabitio? vor allem bei Verfuegungen Nichtberechtigter. Im Gegensatz zum geltenden Recht kann im roemischen Recht auch etwa die Zahlung an einen Geschaeftsfuehrer auf eine nicht bestehende Forderung genehmigt werden. Die Arbeit wurde ausgezeichnet mit dem Preis ≫Hans Ankum≪ der Stiftung ≫Stichting Rechtshistorisch Fonds Mr Joseph Winkel≪.
