In his renowned collection Philosophy as a Way of Life, Pierre Hadot suggests that the original aspect of philosophy as a method by which one exercises oneself to achieve a new way of living and seeing the world fails with the rise of modernity. In that period, philosophy becomes increasingly theoretical, tending toward a system. However, Hadot himself glimpses at the dawn of modernity some instances of the original aspect of philosophy still very much present, and in his wake, Michel Foucault warns that between the late 16th and early 17th centuries the philosophical question of the reform of the mind attests to a still very close link between asceticism and access to truth.

This book aims to develop just such an idea by thoroughly analyzing the most representative works of the reform of the mind in the early modern period: Francis Bacon's New Organon (1620), Rene Descartes' Discourse on the Method (1637), and Baruch Spinoza's Treatise on the Emendation of the Intellect (1677). From this analysis it will emerge that these modern works fully deserve to be counted among the tradition of philosophy as way of life. On closer inspection, the inquiries about method elaborated in these works are fully understandable only when read in the light of a broader and more complex philosophical need: to establish the spiritual conditions for accessing truth and aspiring to full self-realization.

The open access publication of this book was financially supported by the Swiss National Science Foundation.

This volume sheds new light on modern theories of natural law through the lens of the fragmented political contexts of Italy in the eighteenth and nineteenth centuries, and the dramatic changes of the times. From the age of reforms, through revolution and the 'Risorgimento', the unification movement which ended with the creation of the unified Kingdom of Italy in 1861, we see a move from natural law and the law of nations to international law, whose teaching was introduced in Italian universities of the newly created Kingdom. The essays collected here show that natural law was not only the subject of a highly codified academic teaching, but also provided a broader conceptual and philosophical frame underlying the 'science of man'. Natural law is also a language wherein reform programmes of education and of politics have taken form, affecting a variety of discourses and literary genres.

The Working Papers of Hugo Grotius is the first full-length study of the handwritten documents initially used by the author of Mare Liberum (1609) and De Jure Belli ac Pacis (1625) in his day-to-day activities as a scholar, lawyer, and politician, but subsequently incorporated into his own or other archives. Martine van Ittersum reconstructs a process of transmission, dispersal, and loss that started during Grotius' lifetime and ended with the papers' auction in 1864. This is also a study of archival afterlives. This book focuses on two main aspects: legal convergence and crises. Despite the abundance of literature on legal convergence over the years, the question of whether legal systems are converging or diverging remains unanswered. This book provides a valuable contribution to questions concerning comparative law, legal convergence, and legal transplants by examining them through the lens of crises.
Crises challenge countries' legal systems and prompt institutional responses to tackle perceived shortcomings in the law. The crises witnessed by the world over the last two decades have highlighted two seemingly contradictory tendencies:
(i) increased cooperation and a natural phenomenon of legal convergence as states find common solutions to common problems;(ii) a preference for state-centric solutions, which prioritise domestic interests; rejection of supranational standards and harmonisation efforts; and protection of domestic sovereignty.
This book aims to determine whether, in times of crisis, foreign laws, rules, and concepts can transcend countries' domestic legal systems, or whether states' responses to crises lead to legal divergence and disintegration.
Unlike traditional studies on convergence, this edited volume takes an international and cross-thematic approach, with chapters focusing on how legislation in selected jurisdictions has responded to crises. Therefore, the book's originality lies in its truly global nature, with chapters and authors surveying jurisdictions in Africa, North and South America, Asia, Europe and Oceania. The breadth of legal areas covered, with a mix of private and public law, also add to its uniqueness.
From Russia to Germany and from bankruptcy law to environmental law, the book examines whether, as a result of crises, policy and legal responses have adopted, copied, or implemented features, policies, principles and/or rules from other legal systems (convergence), or have departed from existing legal norms, adopting policies and rules that differ from those of other countries (divergence).

How do the history of religion and the history of political freedom relate to each other? The variety of views on this subject in philosophy, the humanities and social sciences, and the public is broad and confusing. But the grandiose synthesis in which Hegel brought together Christianity and political freedom is still an enormous source of orientation for many-despite or even because of the influential provocations of Friedrich Nietzsche. As Hans Joas shows in Under the Spell of Freedom, a different view has developed in the religious thinking of the twentieth century based on a conception of history that is more open to the future and on a concept of freedom that is richer than that of Hegel. Using sixteen selected thinkers, Joas deconstructs the grand Hegelian narrative of human history as the self-realization of the idea of freedom, setting as a counterpart the sketches of a theory of the emergence of moral universalism. Further, taking the classical views of Hegel and his emphasis on the role of Protestant Christianity and the extremely negative views about Christianity in the work of the philosopher Friedrich Nietzsche, Joas elaborates on this new understanding of religion and freedom, which avoids both Eurocentrism and an intellectualist view of religious faith and practice. The result is a forceful plea for a global history of moral universalism. Under the Spell of Freedom is an important step in this direction.

Modality: A History provides readers a sweeping study of the history of philosophical work on modal concepts. Everyday discourse is saturated with appeals to what might be the case or to what must be true or to what cannot happen. Possibility, necessity, and impossibility are modal terms, and philosophers have long wondered how to best understand them. This volume traces the history of some of the most prominent and important contributions to our understanding of possibility and necessity over the past two and half millennia of western philosophy, from ancient Greek philosophers through current debates in the 21st century. Over the course of nine chapters from prominent scholars, this volume traces a history of modal theorizing that begins with extended discussions of Aristotle and the Stoics. Several chapters discuss insights and disagreements among Latin, Arabic, and Jewish medieval scholastics, such as Al-Ghazali, Scotus, and Crescas. Three chapters center on early modern philosophers, whose modal views were deeply shaped by this conceptual inheritance but also departed from it in significant ways: Descartes, Malebranche, Locke, Spinoza, Leibniz, and Hume. Kant and Hegel's modal contributions are presented in their own chapter, and another chapter traces the legacy of Kant's account on early-to-mid 20th century modal views, including Husserl, Heidegger, Russell, and Quine. The revival of modal metaphysics in the more recent work of Kripke, Marcus, and Lewis has led to a new flourishing of modal theories, including in recent debates among neo-Aristotelians, as the final chapter illustrates. Although modal concepts are interesting and important on their own, theories of modality often intersect with other significant philosophical topics, such as time, freedom, and God. Modal concepts also extend beyond metaphysics. To illustrate the role of modality in other domains, several small-scale studies, or Reflections, are dispersed among these main chapters on modality in cosmology, religion, music, literature, and logic. Readers will learn how a seemingly timeless and changeless cluster of modal concepts have undergone significant revisions and enjoy a rich developmental history.
