In Access to Courts for Asylum Seekers and Refugees, Emma Dunlop focuses on the scope and content of article 16 of the 1951 Refugee Convention. Under this article, States are obligated to provide asylum seekers and refugees with access to courts. This obligation entails a requirement to ensure 'effective' access, which may call for accommodations to be made to address individual vulnerabilities -where, for example, a person does not speak the language of the court or lacks easy access to a lawyer. It also guarantees additional rights to those who have attained 'habitual residence' in the host country. Access to courts is a critical gateway right, the denial of which can prevent a person from defending other rights under domestic law. Yet, until now, article 16 has not received extensive scrutiny. In the first dedicated monograph on article 16 of the 1951 Convention, Dunlop positions the article within the broader context of international human rights law, customary international law, and general principles of law, presenting a comprehensive account of asylum seekers' and refugees' right of access to courts. Taking an evolutionary approach to treaty interpretation, the book interrogates the scope and content of the article, evaluating the extent of its obligations. Despite developments in international human rights law since the article's adoption, Access to Courts for Asylum Seekers and Refugees argues that it remains a relevant and robust source of protection. Offering rigorous and reasoned analysis of this critical provision, Dunlop advances a principled approach to interpreting article 16.

This book asks "How can legal doctrine be turned into filmic art?" By "legal doctrine" Stanley Fish does not mean the sonorous abstractions that usually accompany the self-presentation of law--Justice, Equity, Equality, Liberty, Autonomy, and the like. Rather he has in mind the specific rules and procedures invoked and analyzed by courts on the way to declaring a decision--lawyer/client confidentiality, the distinction between interdicted violence and the violence performed by the legal system, the interplay of positive law and laws rooted in morality, the difference between civilian law and military law, the death penalty, the admissibility of different forms of evidence. In the movies he discusses, these and other points of doctrine and procedure do not serve as a background, occasionally visited, to the substantive issues that drive the plot and provide the characters with choices; they declare the plot, and character is formed and tested in relationship to their demands. Apparently technical matters are pressed until they occupy both foreground and background and become the movie's true subject. If large, abstract concepts emerge, they emerge at the back end of doctrine and are, in effect, produced by doctrine. These are not law-themed movies; they are movies about the unfolding of legal process.

This book charges that just about every philosophical theory of mind or language developed over the past 50 years in the West is systematically inaccurate. Systemic oppression has influenced the processes that theories of mind or language purport to identify; however, that same systemic oppression has also made it so that most middle-to-upper class White men (including most philosophers of mind or language) are ignorant of systemic oppression. Consequently, most theories of mind or language are systematically inaccurate because they fail to account for the influences of systemic oppression. Philosopher Jeff Engelhardt argues for the de-idealization of two influential theories in the philosophy of mind and language--social externalism and objective type externalism--and considers some consequences of the de-idealization project. Following the work of Charles Mills, Engelhardt argues that ideal theories adopt oppression-obscuring assumptions while nonideal theories avoid them (or at least try to). Ideal theories assume that language users are basically equal, and that social institutions and structures are basically just, but scholarship on Western social relations, institutions, and structures shows that in fact each of these is systematically influenced by oppression. Consequently, ideal theories tend to be systematically inaccurate. Moreover, since oppression systematically produces ignorance of systemic oppression, such systematically inaccurate theories are likely the norm rather than the exception. Engelhardt shows that once we've shown that oppression systematically influences the processes that determine linguistic meanings (according to content externalism), then we have reason to expand our notion of hermeneutical injustice, we have evidence that hermeneutical injustice occurs systematically, and we have grounds for expanding discussions of conceptual engineering to include questions about engineering the processes that determine concepts, not just concepts themselves.

Schopenhauer is most recognizable as "the philosopher of pessimism," the author of a system that teaches how art and morality can help human beings navigate life in "the worst of all possible worlds." This dominant image of Schopenhauer has cut off an important branch of his tree of philosophy: the metaphysics of nature and its dialogue with the sciences of the time. A Convex Mirror sheds new light on the development of Schopenhauer's philosophy and his ongoing engagement with the natural sciences. Understanding Schopenhauer's metaphysics requires both an insight into his relationship with science and an appreciation of the role of the natural sciences in his philosophical project. In the first edition of The World as Will and Representation (1819), Schopenhauer dealt with science within the framework of Kant and Schelling's philosophies of nature, but his growing perplexity with them led him to an original, more complex conception of the relationship between science and metaphysics. He therefore embarked on a revision of his metaphysics of nature, which ultimately affected its core concepts--namely, the will and ideas--and influenced his decision to publish a volume of Supplements (1844) rather than a revised edition of his main work. The evolving relationship of Schopenhauer's philosophy to the natural sciences is a powerful interpretative tool: a "convex diffusing mirror" that reflects the totality and complexity of his system and sheds light on the core concepts of his philosophy, such as the systematic structure of his philosophy, reality and representation, idealism and realism, the polysemic nature of ideas, and the will as the thing in itself.

Children in Police Custody shines a light on the hidden experiences of children in police detention in England and Wales. An episode in police custody is the single most common sustained experience of the criminal justice system for children. Yet child suspects have previously been largely overlooked in criminological research. Drawing on the first comprehensive study in England and Wales to review the police custody process from the perspective of children, the chapters trace the child's journey from arrest, through detention and interview, to release or remand. Adopting a rights-based approach, this work investigates whether the present legal framework provides effective protection for child suspects. Utilising the detailed insights provided by young participants in the research, and supplemented by the author's fieldwork, this analysis reveals the complex challenges facing children's legal agency in the adversarial setting of the custody block. In so doing, it evaluates the capacity of the available protections to enable children's participation in that setting. A parallel criminological exploration examines the intersecting adversities experienced by child suspects, and the complex power dynamics they navigate in police custody, to arrive at an understanding of the particular harms of police detention for children and their longer-term impact. The book closes with a call for a retrenchment in the use of police custody for children, and a reappraisal of how those who must be detained should be supported to enable their effective participation in the criminal justice process, both in custody and beyond.

Shaping Contracts for Work provides an in-depth examination of the common law's role in shaping employment contracts through the mechanism of implied terms. It constructs a theory which views the nature of the employment contract as distinct from other types of work contract. Terms implied by law into employment contracts, as well as their potential to operate in other non-standard contracts for the performance of work, are critically examined by reference to the test that courts adopt when they are asked to imply such terms. In part one, Golding provides an overarching survey of the law which governs express and implied terms in contracts. In doing so, she considers the broader judicial role in implying terms and assesses how it can fundamentally alter the nature of the relationship between contracting parties. Part two draws comparisons between England and Australia, tracing the origins and status of select terms across both jurisdictions, and exploring how the application of these terms is often presumed. In part three, Golding demonstrates why courts need to better articulate their understanding of what constitutes an 'employment contract' as a distinctive class of contract. In Civil Society's Democratic Potential, Nicole Bolleyer explores which civil society organizations (CSOs) contribute to democracy, how, and why. Organized civil society, including interest groups, political parties, and service-oriented associations, is traditionally considered a cornerstone of democracy. Constituting the organizational fabric between government and society, these organizations encompass a wide diversity of entities thought to fundamentally contribute to both democratic participation and representation. However, CSOs' readiness and ability to serve as venues for participation, vehicles of democratic representation, or indeed both at the same time, are increasingly questioned in political science, sociology, and voluntary sector research alike. Bringing those fields together, the author argues that two contrasting organizational templates - the 'voluntary association' and the 'professionalized voluntary organization' - allow theorizing fundamental trade-offs shaping CSOs' 'performance' on three dimensions accounting for their varying democratic contributions: participation, representation, and societal responsiveness. The study's innovative theoretical framework is examined using a mixed-methods design. The latter combines the analysis of survey data covering over 3000 CSOs across four European democracies with qualitative case studies of the evolution of three CSOs - a political party, an interest group, and a service-orientated organization - over several decades.

The digital transformation of the public sector has accelerated. States are experimenting with technology, seeking more streamlined and efficient digital government and public services. However, there are significant concerns about the risks and harms to individual and collective rights under new modes of digital public governance. It seeks to ensure through its contracts that public sector digitalisation is trustworthy, ethical, responsible, transparent, fair, and (cyber) safe. However, in Digital Technologies and Public Procurement: Gatekeeping and Experimentation in Digital Public Governance, Albert Sanchez-Graells argues that procurement cannot perform this gatekeeping role effectively. Through a detailed case study of procurement digitalisation as a site of unregulated technological experimentation, he demonstrates that relying on 'regulation by contract' creates a false sense of security in governing the transition towards digital public governance. This book explores the meaning of 'investment' within the context of International Centre for Settlement of Investment Disputes (ICSID) arbitration. It provides a comprehensive and detailed examination of the various legal issues arising in connection with the jurisdictional requirement of the existence of an investment. It explores, first of all, the fundamental question of whether the term 'investment' in Art. 25 ICSID Convention has - despite not being defined - some objective or independent meaning. Second, it addresses the substance of that meaning, showing that three main approaches (the prevailing Salini test, the permissibility test, and the commercial-transaction test) co-exist in arbitral practice. Third, it analyses the definitions of 'investment' found in investment treaties including the traditional definitional model, typical requirements, and recent developments in practice. Fourth, it provides an overview of definitions contained in domestic investment laws, highlighting commonalities with, and differences from, definitions found in investment treaties. Finally, it examines the investment status of several specific categories of assets and operations. The Concept of Investment in ICSID Arbitration offers not only a detailed analysis of the relevant case law, legislation, and scholarship, but also a critical assessment of existing practices and trends, as well as normative recommendations. It also explores issues that are neglected in the existing literature, such as the question of the nature of investment, recent trends in treaty drafting and arbitral case law, and definitions of 'investment' contained in investment laws. The close connection between time and politics is central to many political debates. Turbulence, emergencies, and crisis politics have led to criticism about the marginalization of deliberative institutions, notably parliaments, as time pressures appear to have concentrated decision-making in small circles. Non-majoritarian institutions that do not follow electoral rhythms, such as central banks, are said to have gained in power. Some observers fear that democracy is being "timed out". By contrast, many analysts of public policy criticize democracy for its electoral time horizons. Perpetrators of mass atrocities have used displacement to transport victims to killing sites or extermination camps to transfer victims to sites of forced labor and attrition, to ethnically homogenize regions by moving victims out of their homes and lands, and to destroy populations by depriving them of vital daily needs. Destroying Them Gradually examines four cases that illuminate why perpetrators have destroyed populations using displacement policies: Germany's genocide of the Herero (1904-1908); Ottoman genocides of Christian minorities (1914-1925); expulsions of Germans from East/Central Europe (1943-1952); and climate violence (twenty-first century).
