Die Statistik belegt, dass sich Kommunen bei der wirtschaftlichen Betaetigung ueberwiegend privatrechtlicher Organisationsformen des Gesellschaftsrechts bedienen. Wird dieser Weg beschritten und die Rechtsform der GmbH oder der Aktiengesellschaft gewaehlt, hat dies fuer die Kommune die rechtliche Konsequenz, dass sowohl die Vorgaben des Gesellschaftsrechts zu beachten sind als auch eine Bindung an das Gemeindewirtschaftsrecht besteht. Diese doppelte Bindung kann zu Problemen fuehren, wenn beide Rechtsquellen widerspruechliche Anforderungen an die Kommune stellen. Wie solche Widersprueche aufzuloesen sind, wird seit Jahrzehnten diskutiert. Die hiesige Untersuchung analysiert die bisherigen Ansaetze und offenbart eine partielle Verfassungswidrigkeit des Kommunalwirtschaftsrechts de lege lata. Abschliessend wird ein neuer Loesungsansatz vorgestellt, der im Einklang mit den verfassungsrechtlichen Anforderungen steht und gleichzeitig oekonomischen Belangen Rechnung traegt.

On Final Decision Powers and Authority in the Multidimensional System of the European Union and their Effects on the Procedural Autonomy of the Member States≪: So far, there has been a general understanding that European administrative law is unfamiliar with the fine distinction between the margin of appreciation regarding legal facts and legal implications (so-called administrative final decision powers), which is a central element of German administrative law dogmatics and which has been decisively promoted by the latter. Decisively, this understanding stems from the early economic administrative law of the 1980s, which can hardly cover the scope of today's existing legal frameworks. Against this background, the thesis puts a possible dogmatization of the existing understanding of a standardized administrative final decision power on trial and makes an attempt at a methodical integration in the multidimensional system of European administrative law. The investigation is not carried out from the abstract perspective of the German system (≫General Part≪ and ≫Special Part≪), but rather from the concrete reference areas of the specialized law.

In the literature on forced migration, little is known about the experiences of Iraqi refugees resettled in the United States through the US Refugee Admissions, Reception and Placement Program. As part of its longstanding refugee resettlement policy, the United States has accepted and provided safe haven to thousands of refugees. Focusing primarily on the situation of Iraqis resettled in Arizona since the 1990s, this research uses interview findings and first-hand data to examine various aspects of their post-resettlement experiences through a meta-theoretical approach that includes aspects of humanitarian governance, adaptation, acculturation and integration. Building on this theoretical understanding, this book examines the process from the first moment of resettlement to integration as a multi-layered social reality and reveals the fundamental impact of forced migration on the 'politics of refugee life'. By examining the US resettlement program in relation to the role and functionsof resettlement agencies and non-profit organizations in collaboration with the government, this book highlights the fundamental difference between refugee integration and migrant integration, introduces new concepts of integration, discusses the US refugee admissions, reception and placement program and refugee integration in relation to the organization of humanitarian governance globally, and offers recommendations for improving resettlement and integration processes.

Urban violence still has a peculiar standing within social and urban research. This book works to unpack the link between urban, violence, and security with three main arguments.
The first is that urban violence is under-theorized because long-term theoretical problems with both of its elements ('urban' and 'violence').
The second is to answer these questions: (1) how can violence be conceptualized in a way that opens to an understanding of the specificity of urban violence? (2) What is the urban in urban violence? And (3) How can 'urban' and 'violence' be articulated in a way that makes urban violence a category with both analytical and strategic power?

The book offers a systematic reconstruction of the disagreement between Husserl and Heidegger from the former's perspective, but without falling into any form of Husserlian apologetics. The main thesis is that Husserl's critique of Heidegger's existential analytics as a form of philosophical anthropology entails a deeper fundamental thesis, namely that Heidegger confuses the object of first philosophy (the transcendental determination of the subject) with metaphysics (in the Husserlian sense of the expression). Addressing the Husserl-Heidegger confrontation, this text provides the first systematic reconstruction of Husserl's conception of the system of philosophy from the perspective of his later works, with a special focus on the Cartesian Meditations. At stake in Husserl's critique of Heidegger's philosophy in Being and Time is the refusal to transcendentalize the irrational aspects and nature of our human existence. This first volume addresses Husserl's doctrine of transcendental idealism with the aim of elucidating the distinction between first philosophy, second philosophies and what Husserl calls last philosophy.
