Advancing a phenomenological approach to deep time

Our imagination today is dominated by the end of the world, from sci-fi and climate fiction to actual predictions of biodiversity collapse, climate disruption, and the emergence of the Anthropocene. This obsession with the world's precarity, The Memory of the World contends, relies on a flawed understanding of time that neglects the past and present with the goal of managing the future. Not only does this mislead sustainability efforts, it diminishes our encounters with the world and with human and nonhuman others.

Here, Ted Toadvine takes a phenomenological approach to deep time to show how our apocalyptic imagination forgets the sublime and uncanny dimensions of the geological past and far future. The unification of international commercial law has been a common course for every country of the world. The U.N. Convention on Contracts for International Sale of Goods (CISG) is a milestone in creating a uniform law in the field of the international sale of goods. The CISG coordinated divergent political, economic, and legal systems combined different contract laws and set up a comprehensive and independent legal framework for the international sale of goods.

This book examines the basic requirements and criteria of the CISG's interpretation and investigates how to achieve the uniform interpretation of the CISG based on interpretation rules in the CISG and through appropriate legal interpretation approaches.

As a comprehensive and uniform legal framework for the international sale of goods, the CISG still has gaps to fill. Therefore, a uniform interpretation in gap-filling is equally important for the CISG. This book discusses gap-filling in the CISG, explains why and how to fill its gaps, clarifies gap-filling approaches, their order of application, and eventually concentrates on general principles and the uniform interpretation of the CISG.

Another feature of the book is to discuss the supplementary materials that could be used to assist in the uniform interpretation of the CISG. PICC, foreign cases, UNCITRAL Digest, and the CISG Advisory Council opinions will be examined in detail to see whether and how they can fill the gaps in the CISG and promote its uniform interpretation.

Only by clarifying the basic requirements and principles relating to the CISG's uniform interpretation, can courts and arbitral tribunals correct their attitude toward and practices in the interpretation of the CISG. Only by following the autonomous interpretation approach, can the CISG achieve its goal to unify the sale of goods laws and promote the development of international commerce.

Austinian Themes offers a reconstruction of philosophical views on several themes developed by J. L. Austin. Exploring Austin's work in detail through a series of thematically organized chapters, Marina Sbisa draws on both published work as well as unpublished manuscript notes to offer a defence of Austin's speech act theory, characterized by a specific notion of illocution, against some important criticisms. Sbisa offers a reconstruction of Austin's responsibility-based conception of action drawing on his remarks on acts and actions in How to Do Things with Words and in later papers. Exploring Austin's contributions to epistemology and the philosophy of perception (including his realist stance, anti-scepticism, and presentational view of perception), Sbisa analyses the roles that he assigns to knowledge in the dynamics of assertion. On the theme of truth, Austin's claims are expounded and explained as worthy of reassessment. Other chapters explore the ways in which Austin deals with sense, reference, 'family resemblances', truth-falsity assessments, and context-dependence. Austin's most famous statement of method, as outlining a 'linguistic phenomenology', is cast as analogous to Husserl's phenomenology in adopting an epoche which isolates language (rather than consciousness), a reading which helps to clarify several characteristic positions adopted by Austin. On metaphilosophical themes, Sbisa analyses the notion of ordinariness, distinguishing it from common sense and the endorsement of the 'Linguistic Turn', approaching it instead in terms of the by-default nature of the social bond and conversational cooperation. Various recurrent aspects of Austin's philosophy are illuminated: the opposition to dichotomies, the attention paid to intersubjectivity, the commitment to a 'sober' philosophy, and a strong sense of human situatedness.

Freedom is celebrated as the definitive ideal of modern western civilization. Yet in western thought and practice, the freedom of some has typically been defined through opposition to the unfreedom of others. These exclusions are not secondary to a prior concept of freedom but are constitutive exclusions that have shaped the ways in which western theorists define what freedom is. Allison Weir draws on Indigenous political philosophies and practices of decolonization grounded in conceptions of relationality and resurgence, in dialogue with western philosophies, to reconstruct a tradition of relational freedom as a distinctive political conception of freedom: a radically democratic mode of engagement and participation in social and political relations with an infinite range of strange and diverse beings perceived as free agents in interdependent relations in a shared world. Through the work of Leanne Betasamosake Simpson, John Borrows, Glen Coulthard, Audra Simpson, Rauna Kuokkanen, Joanne Barker, Jodi Byrd, James Tully, and many others, this book traces a tradition of colonial unknowing in western conceptions of freedom from Hobbes through republican and critical theories, and explores a countertradition of relations between freedom and collective love, exemplified in Leanne Betasamosake Simpson's love of land and Hannah Arendt's love of the world. It considers Indigenous modes of world-creation as performative, affective, embodied strategies of democratic life, skilled modes of addressing diversity and conflict, fear and hostility, in practices of freedom that embrace polycentric knowledges and rooted dynamisms, in contexts of complexity and constant change. Weir argues that Indigenous women's struggles to belong to communities and participate in governance have engendered new theories of relational rights that combine politics of rights and resurgence, and calls for a coalitional politics guided by queer and feminist Indigenous models of transformative resurgence. Finally, Weir proposes an approach to critical theory as a practice of self-transformation through openness to the other, oriented toward relational freedom.
