This book explores the role of gender in the recognition of an individual's legal capacity. It discusses the meaning of the right to legal capacity and its two core elements - legal personhood and legal agency. It then analyses historical and modern denials of personhood and agency experienced by women, disabled women, and gender minorities - for example, prohibitions from voting, limitations on contracting, loss of personhood upon marriage, and gender binary requirements leading to an inability to exercise legal capacity, among others. Using critical feminist, disability, and queer theory, this book also offers insights into the construction of legal personhood and its role as a predictor of power and privilege. The book identifies patterns of oppression through legal capacity denial in various jurisdictions and discusses situations in which modern law continues to enforce these denials. In addition, the book presents solutions: it identifies practices to learn from in various jurisdictions around the world - including both civil law and common law jurisdictions. It also uses case studies to illustrate the ways in which existing laws, policies and practices could be reformed. As such, the book offers both a novel contribution to the field of legal capacity law and a tool for creating change and helping to realise the right to legal capacity for all.

Gender and Tourism: Challenges and Entrepreneurial Opportunities adopts a multi-disciplinary approach, building on a historically informed, future-focused research agenda that accounts for the needs and concerns of contemporary policy makers and practitioners in the tourism field.

The process of identity construction and the religious values of women have also been extensively researched. But little is known about the role of Muslim women in the tourism industry and this book addresses these themes in the Asian context. This book explores these ideas as defined key categories; Muslim women from Asia travelling to a non-Muslim country, non-Muslim women travelling to Asian Muslim countries, and Women working in the tourism field in Muslim countries.

This book highlights Asian countries as holding a complex mixture of cultures and identities. As Muslim communities are central in many Asian countries the tourism experience is different mainly because of cultural norms and religion. Ultimately, this book examines whether and how these complexities enrich both women and tourism industry within Asian context.

The chapters in this book were originally published as a special issue of the British Journal for the History of Philosophy.

As women-entrepreneurs circumvent challenges and obstacles, they also ameliorate the cultural context for future women entrepreneurs. In the mid-1990s, experts predicted that India would face the world's biggest AIDS epidemic by 2000. Though a crisis at this scale never fully materialized, global public health institutions, donors, and the Indian state initiated a massive effort to prevent it. HIV prevention programs channeled billions of dollars toward those groups designated as at-risk-sex workers and men who have sex with men. At Risk captures this unique moment in which these criminalized and marginalized groups reinvented their "at-risk" categorization and became central players in the crisis response. The AIDS crisis created a contradictory, conditional, and temporary opening for sex-worker and LGBTIQ activists to renegotiate citizenship and to make demands on the state.

Working across India and Kenya, Gowri Vijayakumar provides a fine-grained account of the political struggles at the heart of the Indian AIDS response. These range from everyday articulations of sexual identity in activist organizations in Bangalore to new approaches to HIV prevention in Nairobi, where prevention strategies first introduced in India are adapted and circulate, as in the global AIDS field more broadly. Vijayakumar illuminates how the politics of gender, sexuality, and nationalism shape global crisis response. In so doing, she considers the precarious potential for social change in and after a crisis.

Surfacing in the mid-twentieth century, yet shrouded in social stigma, transgender medicine is now a rapidly growing medical field. In Trans Medicine, stef shuster makes an important intervention in how we understand the development of this field and how it is being used to "treat" gender identity today.
Drawing on interviews with medical providers as well as ethnographic and archival research, shuster examines how health professionals approach patients who seek gender-affirming care. From genital reconstructions to hormone injections, the practice of trans medicine charts new medical ground, compelling medical professionals to plan treatments without widescale clinical trials to back them up. Relying on cultural norms and gut instincts to inform their treatment plans, shuster shows how medical providers' lack of clinical experience and scientific research undermines their ability to interact with patients, craft treatment plans, and make medical decisions. This situation defies how providers are trained to work with patients and creates uncertainty. As providers navigate the developing knowledge surrounding the medical care of trans folk, Trans Medicine offers a rare opportunity to understand how providers make decisions while facing challenges to their expertise and, in the process, have acquired authority not only over clinical outcomes, but over gender itself.

The struggles African American women and their adolescent daughters face in living healthy, active lives

Adolescents in Humanitarian Crisis investigates the experiences of adolescents displaced by humanitarian crisis.

The world is currently seeing unprecedented levels of mass displacement, and almost half of the world's 70 million displaced people are children and adolescents under the age of 18. Displacement for adolescents comes with huge disruption to their education and employment prospects, as well as increased risks of poor psychosocial outcomes and sexual and gender-based violence for girls. The open access book provides a critical account of parenthood in Polish society. It uses a qualitative perspective to show how mothers and fathers engage with parenthood and also function in the labour market. Parenting in contemporary Poland is not only affected by individual preferences and choices, but significantly by the institutional context, in particular the family policy system, as well as socio-cultural norms of how men and women should fulfill parental roles. The author distinguishes between different kinds of work done in connection to parenthood and shows how the existing institutional system reinforces gender and other forms of social inequalities even in a post-communist state like Poland. The author demonstrates that Polish society has different expectations and institutional norms related to work and gender norms compared to those in long-standing democracies in Europe and elsewhere. The book also shows that the experiences of parenthood in Poland are different between men and women, between single and coupled parents, and based on economic and other resources. This book is of interest to social science students and researchers of family studies, parenting, sociology of work, and social structure in post-communist societies.

Women in the Sky examines Korean women factory workers' century-long activism, from the 1920s to the present, with a focus on gender politics both in the labor movement and in the larger society. It highlights several key moments in colonial and postcolonial Korean history when factory women commanded the attention of the wider public, including the early-1930s rubber shoe workers' general strike in Pyongyang, the early-1950s textile workers' struggle in South Korea, the 1970s democratic union movement led by female factory workers, and women workers' activism against neoliberal restructuring in recent decades.

Hwasook Nam asks why women workers in South Korea have been relegated to the periphery in activist and mainstream narratives despite a century of persistent militant struggle and indisputable contributions to the labor movement and successful democracy movement. At the turn of the twentieth century, the United States was experiencing an awakening. Victorian-era morality was being challenged by the introduction of sexual modernism and women's rights into popular culture, the arts, and science. Set during this first sexual revolution, when civil libertarian-minded lawyers overthrew the yoke of obscenity laws, Dirty Works focuses on a series of significant courtroom cases that were all represented by the same lawyer: Morris L. Ernst.

Ernst's clients included a who's who of European and American literati and sexual activists, among them Margaret Sanger, James Joyce, and Alfred Kinsey. They, along with a colorful cast of burlesque-theater owners and bookstore clerks, had run afoul of stiff obscenity laws, and became actors in Ernst's legal theater that ultimately forced the law to recognize people's right to freely consume media. In this book, Brett Gary recovers the critically neglected Ernst as the most important legal defender of literary expression and reproductive rights by the mid-twentieth century. Each chapter centers on one or more key trials from Ernst's remarkable career battling censorship and obscenity laws, using them to tell a broader story of cultural changes and conflicts around sex, morality, and free speech ideals.

Dirty Works sets the stage, legally and culturally, for the sexual revolution of the 1960s and beyond. In the latter half of the century, the courts had a powerful body of precedents, many owing to Ernst's courtroom successes, that recognized adult interests in sexuality, women's needs for reproductive control, and the legitimacy of sexual inquiry. The legacy of this important, but largely unrecognized, moment in American history must be reckoned with in our contentious present, as many of the issues Ernst and his colleagues defended are still under attack eight decades later.
