Arbeitnehmerueberwachung ? ein Thema an der Schnittstelle zwischen Arbeits-, Datenschutz- und Strafrecht. Vor allem das Datenschutzrecht hat sich mit dem BDSG und der DSGVO in den letzten 20 Jahren rasant weiterentwickelt. Gleichwohl konnte sich der deutsche Gesetzgeber bis jetzt immer noch nicht dazu durchringen, ein eigenstaendiges Beschaeftigtendatenschutzgesetz zu erlassen. Folglich sind die (strafrechtlichen) Grenzen der Zulaessigkeit von Ueberwachungsmassnahmen am Arbeitsplatz nach wie vor nicht hinreichend geklaert. Der Verfasser knuepft hieran an und geht auf die praktisch wichtigsten Ueberwachungsmassnahmen des Arbeitgebers (Video- und Telefonueberwachung, Telekommunikationsueberwachung, Postkontrolle und GPS-Ueberwachung) ein. Mit der Untersuchung erarbeitet der Verfasser im Wege eines materiell-rechtlichen und prozessualen Vergleichs zwischen Arbeits-, Datenschutz- und Strafrecht ein kohaerentes, in sich geschlossenes System der Arbeitnehmerueberwachung. Analysiert wird zuerst die materiell-strafrechtliche Ebene (Paragr. 201-206 StGB und Paragr. 42 BDSG) unter besonderer Beruecksichtigung arbeits- und datenschutzrechtlicher Wertungen. Vor allem wird der Frage nachgegangen, ob die datenschutzrechtliche Erlaubnisnorm aus Paragr. 26 BDSG als strafrechtlicher Rechtfertigungsgrund fungieren kann. Im Anschluss wird die prozessuale Lage der Arbeitnehmerueberwachung eroertert und das Verhaeltnis zwischen zivil- und strafprozessualen Beweisverwertungsverboten vor dem Hintergrund des Beschaeftigtendatenschutzes naeher beleuchtet. Der Autor entwickelt dabei einheitliche zivil- wie strafprozessuale Massstaebe fuer die Arbeitnehmerueberwachung.
