Its uniqueness lies in its insistence that the acceptance of value pluralism involves placing certain limitations on what is an acceptable form of government and what functions governments ought to be legitimately performing. In a new approach coined "nomocratic pluralism," this volume argues that liberty under the rule of law, which is not merely liberty where the law is silent, is a key concept of liberty and cannot be subsumed by the other primary implications of the acceptance of value pluralism: that political communities must reject positive liberty as a political value, and place a high, but not absolute, priority on negative liberty as a political value. The concept of liberty under the rule of law is particularly suited to accommodate a great variety of individual and group conceptions of value and the moral good, and thus, along with negative liberty, should be a primary value for those who accept value pluralism.

An acclaimed political theorist offers a fresh, interdisciplinary analysis of the politics of refusal, highlighting the promise of a feminist politics that does not simply withdraw from the status quo but also transforms it.

The Bacchae, Euripides's fifth-century tragedy, famously depicts the wine god Dionysus and the women who follow him as indolent, drunken, mad. But Bonnie Honig sees the women differently. They reject work, not out of laziness, but because they have had enough of women's routine obedience. Later they escape prison, leave the city of Thebes, explore alternative lifestyles, kill the king, and then return to claim the city. Their "arc of refusal," Honig argues, can inspire a new feminist politics of refusal.

Refusal, the withdrawal from unjust political and economic systems, is a key theme in political philosophy. Its best-known literary avatar is Herman Melville's Bartleby, whose response to every request is, "I prefer not to." A feminist politics of refusal, by contrast, cannot simply decline to participate in the machinations of power. Honig argues that a feminist refusal aims at transformation and, ultimately, self-governance. Withdrawal is a first step, not the end game.

Rethinking the concepts of refusal in the work of Giorgio Agamben, Adriana Cavarero, and Saidiya Hartman, Honig places collective efforts toward self-governance at refusal's core and, in doing so, invigorates discourse on civil and uncivil disobedience. She seeks new protagonists in film, art, and in historical and fictional figures including Sophocles's Antigone, Ovid's Procne, Charlie Chaplin's Tramp, Leonardo da Vinci's Madonna, and Muhammad Ali. Rather than decline the corruptions of politics, these agents of refusal join the women of Thebes first in saying no and then in risking to undertake transformative action.

This is the Great Recoil, the era when the neo-statist endopolitics of national sovereignty, economic protection and democratic control overrides the neoliberal exopolitics of free markets, labour flexibility and business opportunity.

Looking back to the role of the state in Plato, Machiavelli, Hobbes, Hegel, Gramsci and Polanyi, and exploring the discourses, electoral programs and class blocs of the nationalist right and socialist left, Paolo Gerbaudo fleshes out the contours of the different statisms and populisms that inform contemporary politics. Crisis dominates the present historical moment. The economy is in crisis, politics in both its past and present forms is in crisis and our own individual lives are in crisis, made vulnerable by the fluctuations of the labor market and by the undoing of social and political ties we inherited from modernity. Yet, traditional views of crises as just temporary setbacks do not seem to hold any longer; this crisis seems permanent, with no way out and no alternatives on the horizon.

Reconstructing a political genealogy of the term from the Greek world to today's neoliberalism, this book demonstrates that crisis, understood as a "choice" between revolution and conservation, is a peculiarity of the modern era that does not apply to the present day. However, since its origin, the trope of crisis has proven to be one of the most effective instruments of social discipline and administration. The analytical trajectory followed by this book - which spans from Plato to Hayek, from the juridical and medical science of antiquity to the current technocracy, passing through the "weapons of criticism" of Marx and Gramsci - finally identifies, following Benjamin and Foucault, precariousness as the "form of life" that characterizes crisis understood as an art of government. This book departs from the attempt by political theory to confront the challenges of political life with new concepts, offering instead a mode of thought so far excluded from the canon of political theory: the philosophy of presence. Making the experience of liminality the very centre of thought, it shows how embracing 'in-betweenness' allows us to discern the limits of both the political order and contemporary political theory. Through an examination of the works of Gustav Landauer, Eric Voegelin, Simone Weil and Vaclav Havel, the author demonstrates the manner in which 'in-betweenness' may be cultivated by way of the philosophy of presence as a method of self-enquiry into existence as it is experienced subjectively. This book explores how formal-legalism, as the dominant paradigm of explanation, has sought to explain the phenomenon of secessionism among its practitioners as a problem for the modern state. This study bears how these practitioners have, over time, described, defined, and proposed to solve secessionism and related political problems within the logic of their paradigm. In the process, the book reconstructs the formalist worldview and the practitioners' fundamental presuppositions which, to them, render comprehensible and meaningful the occurrence of events, like secession, as well as means of dealing with it. More significantly, the book exposes a debilitating flaw of formal-legalist paradigm as it fails to account for other principles of mobilization in political and social life that defy formal-legal rules such as those based on race, ethnicity, language, culture, and material factors.
Narrow adherence to textual sources and the literal approach, have led formal-legalists to miss, willfully ignore, or endorse the paradigm's strategic association with state power, evolving since the dawn of the Enlightenment. Formal-legalism has lent itself amenable to the interests of the state and to the variable construction of the meaning of the law devoid of original spirit and universality but conforming with the specific interests of the state or, for that matter, the prevailing American empire, both spatially and temporally. Accounting for this anomaly, the historical materialist perspective is considered, with appropriate historical and contemporary illustrations, as a relevant explanatory alternative to the now-obsolescent formal-legalist paradigm. With the assumption that, indeed, economic and material considerations such as those demanded by the dominant class elements within the state underlie the rationale for the state, formal-legalism has evolved from one that initially provided a presumed objective view of society to one that has subjectively become an essential part of the cultural suprastructure that allows these elements to command the state as a principal tool for labor- and value-extraction during what is popularly known as contemporary neoliberal globalization.

This volume addresses the normative legitimacy of the international order, asking how we can make sense of legitimacy claims of increasingly diverse global governance institutions and practices and how their legitimacy relates to and differs from state legitimacy.

State legitimacy is a central concern of modern political thought but is inadequate when applied to institutions that differ from the state in type, level of governance, scope, and much else. We need a new, tailored approach to the legitimacy of institutions beyond the state, especially international and transnational institutions. Such an approach includes foundational questions: what does it mean for institutions to be legitimate that have radically different purposes, means, interests, capacities, constituents, and roles from states? And what standards do such institutions have to meet in order to count as legitimate? The contributions to this volume seek to advance the debate on these questions at both abstract and more concrete levels. They range from conceptual questions about the nature of legitimacy and international institutions, to rule of law, to the legitimacy of the UN Security Council, the International Criminal Court, and occupying military forces in the face of challenges specific to their nature and context. Together they demonstrate both the promise and challenges of theorizing legitimacy beyond the state.

The chapters in this book were originally published as a special issue of the journal Critical Review of International Social and Political Philosophy.
