Are victims of armed conflict entitled to reparation, which legal rules govern the question, and how can reparation be implemented? These key questions of transitional justice are examined by three scholars whose professional, theoretical, and methodological backgrounds and outlooks differ greatly. They discuss how regional human rights case law, international criminal law, the practice of ad hoc international bodies, and domestic practice give rise to a right to reparation. This right emerges out of the interplay between international and domestic law. The problems of mass claims, fragile statehood, and the high risk of marginalisation of particular groups of victims are addressed. The analysis is alert to the current backlash against international legal institutions, and to the practical constraints in making post-conflict law work. The multiperspectivism of the trialogical setting exposes the divergence and complementarity of the authors' approaches and leads to a richer understanding of the law of reparation.

Within the liberal tradition, the physical body has been treated as a focus of rights discussion and a source of economic and democratic value; it needs protection but it is also one's dominion, tool, and property, and thus something over which we should be able to exercise free will. However, the day-to-day reality of how we live in our bodies and how we make choices about them is not something over which we can exercise full control. In this way, embodiment mirrors life in a pluralist body politic: we are interdependent and vulnerable, exposed with and to others while desiring agency. As disability, feminist, and critical race scholars have all suggested, barriers to bodily control are often a problem of public and political will and social and economic structures that render relationality and caring responsibilities private, invisible, and low value. These scholarly traditions firmly maintain the importance of bodily integrity and self-determination, but make clear that autonomy is not a matter of mere non-interference but rather requires extensive material and social support. Autonomy is thus totally intertwined with, not opposed to, vulnerability. Put another way, the pursuit of autonomy requires practices of humility. Given this, what do we learn about agency and self-determination, as well as trust, self-knowledge, dependence, and resistance under such conditions of acute vulnerability? The Virtues of Vulnerability looks at the question of how we navigate "choice" and control over our bodies when it comes to conditions like birth, illness, and death, particularly as they are experienced within mainstream medical institutions operating under the pressures of neoliberal capitalism. There is often a deep disconnect between what people say they want in navigating birth, illness, and death, and what they actually experience through all of these life events. Practices such as informed consent, the birth plan, advanced directives, and the patient satisfaction survey typically offer a thin and unreliable version of self-determination. In reality, "choice" in these instances is encumbered and often determined by our vulnerability at the most critical moments. This book looks at the ways in which we navigate birth, illness, and death in order to think about how vulnerability and humility can inform political will. Overall, the book asks under what conditions vulnerability and interdependence enhance or diminish our sense of ourselves as agents. In exploring this question it aims to produce a new vocabulary for democratic politics, highlighting traits that have profound political implications in terms of how citizens aspire, struggle, relate to, and persevere with each other.

What explains the variety of responses that states adopt toward different refugee groups? Refugees might be granted protection or turned away; they might be permitted to live where they wish and earn an income, pursue education, and access medical treatment; or, they might be confined to a camp and forced to rely on aid while being denied basic services. However, states do not consistently wield their capacity for control, nor do they jealously guard their authority to regulate. In this book, Lamis Elmy Abdelaaty asks why states sometimes assert their sovereignty vis-a-vis refugee rights and at other times seemingly cede it by delegating refugee oversight to the United Nations. To explain this selective exercise of sovereignty, Abdelaaty develops a two-part theoretical framework in which policymakers in refugee-receiving countries weigh international and domestic concerns. Policymakers in a receiving country might decide to offer protection to refugees from a rival country in order to undermine the sending country's stability, saddle it with reputation costs, and even engage in guerilla-style cross-border attacks. At the domestic level, policymakers consider political competition among ethnic groups-welcoming refugees who are ethnic kin of citizens can satisfy domestic constituencies, expand the base of support for the government, and encourage mobilization along ethnic lines. When these international and domestic incentives conflict, the state shifts responsibility for refugees to the UN, which allows policymakers to placate both refugee-sending countries and domestic constituencies. Abdelaaty analyzes asylum admissions worldwide, and then examines three case studies in-depth: Egypt (a country that is broadly representative of most refugee recipients), Turkey (an outlier that has limited the geographic application of the Refugee Convention), and Kenya (home to one of the largest refugee populations in the world). Discrimination and Delegation argues that foreign policy and ethnic identity, more so than resources, humanitarianism, or labor skills, shape reactions to refugees.

The Politics of Federal Prosecution draws upon a wealth of data from 1990s to the present to examine the interplay of political factors and federal prosecution. First, the authors find that congressional and presidential politics affect who becomes federal prosecutors and how long those individuals serve. Second, the book demonstrates that signals of presidential and congressional preferences, along with local priorities, affect key prosecutorial decisions: whether to bring prosecutions, how to approach plea bargaining negotiations, and when to utilize criminal asset forfeiture to cripple criminal activities. In short, the book demonstrates that politics affects the behavior of U.S. Attorneys at nearly every stage of their service.

Democratic Crisis and Global Constitutional Law explains the current weakness of democratic polities by examining antinomies in constitutional democracy and its theoretical foundations. This book argues that democracy is usually analysed in a theoretical lens that is not adequately sensitive to its historical origins. The author proposes a new sociological framework for understanding democracy and its constitutional preconditions, stressing the linkage between classical patterns of democratic citizenship and military processes and arguing that democratic stability at the national level relies on the formation of robust normative systems at the international level. On this basis, he argues that democracy is frequently exposed to crisis because the normative terms in which it is promoted and justified tend to simplify its nature. These terms create a legitimising space in which anti-democratic movements, typically with a populist emphasis, can take shape and flourish.

A critical analysis of the connections that the United States Supreme Court has made between campaign finance regulations and voters' behavior. The sanctity of political speech is a key element of the United States Constitution and a cornerstone of the American republic. When the Supreme Court linked political speech to campaign finance in its landmark Buckley v. Valeo (1976) decision, the modern era of campaign finance regulation was born. The decision stated that in order to pass constitutional muster, any laws limiting money in politics must be narrowly tailored and serve a compelling state interest. The lone state interest the Court was willing to entertain was the mitigation of corruption. In order to reach this conclusion, the Court advanced a sophisticated behavioral model that made assumptions about how laws affect voters' opinions and behavior. These assumptions have received surprisingly little attention until now. In The Appearance of Corruption, Daron Shaw, Brian Roberts, and Mijeong Baek analyze the connections that the Court made between campaign finance regulations and voters' behavior. The court argued that an increase in perceived corruption would lower engagement and turnout. Drawing from original survey data and experiments, they confront the question of what happens when the Supreme Court is wrong-and when the foundation of over 40 years of jurisprudence is simply not true. Even with the heightened awareness of campaign finance issues that emerged in the wake of the 2010 Citizens United decision, there is little empirical support for the Court's reasoning that turnout would decline. A rigorous statistical analysis, this is the first work to simultaneously name and test each and every one of the Court's assumptions in the pre- and post-Citizen's United eras. It will also fundamentally reshape how we think about campaign finance regulation's effects on voter behavior.

While migration has become an all-important topic of discussion around the globe, mainstream literature on migrants' legal adaptation and integration has focused on case studies of immigrant communities in Western-style democracies. We know relatively little about how migrants adapt to a new legal environment in the ever-growing hybrid political regimes that are neither clearly democratic nor conventionally authoritarian. This book takes up the case of Russia-an archetypal hybrid political regime and the third largest recipients of migrants worldwide-and investigates how Central Asian migrant workers produce new forms of informal governance and legal order. Migrants use the opportunities provided by a weak rule-of-law and a corrupt political system to navigate the repressive legal landscape and to negotiate-using informal channels-access to employment and other opportunities that are hard to obtain through the official legal framework of their host country. This lively ethnography presents new theoretical perspectives for studying immigrant legal incorporation in similar political contexts.

The Neoliberal Republic traces the corrosive effects of the revolving door between public service and private enrichment on the French state and its ability to govern and regulate the private sector. Casting a piercing light on this circulation of influence among corporate lawyers and others in the French power elite, Antoine Vauchez and Pierre France analyze how this dynamic, a feature of all Western democracies, has developed in concert with the rise of neoliberalism over the past three decades.

It is often assumed that modern democratic government has a special link with Christianity or was made possible due to Christianity. As a challenge to this belief and echoing a long-held assumption in the republican tradition, Hannah Arendt once remarked that "Washington's and Napoleon's heroes were named Moses and David." In this book, Miguel Vatter reconstructs the political theology of German Jewish philosophers during the twentieth century and their attempts to bring together the Biblical teachings on politics with the Greek and Roman traditions of political philosophy. Developed alongside modern experiences with anti-Semitism, the rise of Zionism, and the return of charismatic authority in mass societies, Jewish political theology in the twentieth century advances the radical hypothesis that the messianic idea of God's Kingdom correlates with a post-sovereignty, anarchist political condition of non-domination. Importantly, Jewish philosophers combined this messianic form of democracy with the ideal of cosmopolitan constitutionalism, which is itself based on the identity of divine law and natural law. This book examines the paradoxical unity of anarchy and rule of law in the democratic political theology developed by Hermann Cohen, Franz Rosenzweig, Gershom Scholem, Leo Strauss, and Hannah Arendt. Critical of the Christian theological underpinnings of modern representative political institutions, this group of highly original thinkers took up the banner of Philo's project to unify Greek philosophy with Judaism, and rejected the separation between faith and reason, as well as the division between Biblical revelation and pagan philosophy. The Jewish political theology they developed stands for the idea that human redemption is inseparable from the redemption of nature. Living Law offers an alternative genealogy of political theology that challenges the widespread belief that modern republican political thought is derived from Christian sources.

This book offers an innovative analytic account of Cicero's treatment of key political ideas: liberty and equality, government, law, cosmopolitanism and imperialism, republican virtues, and ethical decision-making in politics. Cicero (106-43 BC) is well known as a major player in the turbulent politics of the last three decades of the Roman Republic. But he was a political thinker, too, influential for many centuries in the Western intellectual and cultural tradition. His theoretical writings stand as the first surviving attempt to articulate a philosophical rationale for republicanism. They were not written in isolation either from the stances he took in his political actions and political oratory of the period, or from his discussions of immediate political issues or questions of character or behaviour in his voluminous correspondence with friends and acquaintances. In this book, Malcolm Schofield situates the intimate interrelationships between Cicero's writings in all these modes within the historical context of a fracturing Roman political order. It exhibits the continuing attractions of Cicero's scheme of republican values, as well as some of its limitations as a response to the crisis that was engulfing Rome.

Russia's use of its vast energy resources for leverage against post-Soviet states such as Ukraine is widely recognized as a threat. Yet we cannot understand this danger without also understanding the opportunity that Russian energy represents. From corruption-related profits to transportation-fee income to subsidized prices, many within these states have benefited by participating in Russian energy exports. To understand Russian energy power in the region, it is necessary to look at the entire value chain-including production, processing, transportation, and marketing-and at the full spectrum of domestic and external actors involved, from Gazprom to regional oligarchs to European Union regulators.

This book follows Russia's three largest fossil-fuel exports-natural gas, oil, and coal-from production in Siberia through transportation via Ukraine to final use in Germany in order to understand the tension between energy as threat and as opportunity. Margarita M. Balmaceda reveals how this dynamic has been a key driver of political development in post-Soviet states in the period between independence in 1991 and Russia's annexation of Crimea in 2014. An examination of China's participation in the World Trade Organization, the conflicts it has caused, and how WTO reforms could ease them

China's accession to the World Trade Organization (WTO) in 2001 was rightly hailed as a huge step forward in international cooperation. However, China's participation in the WTO has been anything but smooth, with China alienating some of its trading partners, particularly the United States. The mismatch between the WTO framework and China's economic model has undermined the WTO's ability to mitigate tensions arising from China's size and rapid growth. What has to change? China and the WTO demonstrates that unilateral pressure, by the United States and others, is not the answer. Instead, Petros Mavroidis and Andre Sapir show that if the WTO enacts judicious reforms, it could induce China's cooperation, leading to a renewed confidence in the WTO system.

The WTO and its predecessor, the General Agreement on Tariffs and Trade, are predicated on liberal domestic policies. They managed the previous accessions of socialist countries and big trading nations, but none were as large or powerful as China. Mavroidis and Sapir contend that for the WTO to function smoothly and accommodate China's unique geopolitical position, it needs to translate some of its implicit principles into explicit treaty language. To make their point, they focus on two core complaints-that Chinese state-owned enterprises (SOEs) benefit from unfair trade advantages, and that domestic companies, private as well as SOEs, impose forced technology transfer on foreign companies as a condition for accessing the Chinese market-and they lay out specific proposals for WTO reforms.

In an age of global trade disputes, China and the WTO offers a timely exploration of unprecedented challenges to the current multilateral system and fresh ideas for lasting solutions.

Conservative liberals also played a formative role in establishing new international networks, notably the Mont Pelerin Society. The book investigates the rich intellectual inheritance of this variant of new liberalism from aristocratic liberalism, ethical philosophy, and religious thought. It also locates the social basis of conservative liberalism and Ordo-liberalism in the cultivated bourgeois intelligentsia. The book goes on to examine the attempts to embed this new disciplinary form of liberalism in Britain, France, Germany, Italy, and the United States, and to consider the determinants of its varying significance across space and over time.
