Despite the economic relevance of trade secrets, their legal protection is not based on a robust theoretical corpus, and a large uncertainty remains regarding how they should be legally apprehended. The present book investigates the foundations of their legal protection by assessing its justifications and aims to define how this legal apprehension should be organized.
The book starts with a comparative analysis of the US and the EU legal frameworks. It demonstrates the parentship existing between the two systems of protection and highlights that the incremental structuring of trade secrets protection has led to legal systems lacking broad-based conceptual foundations. In both legal orders, trade secrets rely on blurred protection, formally anchored in unfair competition, the strength of which, however, comes closer to that offered by intellectual property law. In this convoluted architecture, the judiciary is required to play a decisive role,especially at the enforcement stage. However, the absence of clarity concerning the telos of trade secrets protection leads to legal uncertainty, potentially incoherent enforcement, and, all in all, to inefficient outcomes from a welfare perspective.
The book then explores a theoretical framework based on a distinction between two legal objects: the undertakings' secret sphere and secret pieces of information. Securing the undertakings' secret sphere appears as a condition for the competition process to happen in an economy working under structural uncertainty. It requires objective regulations enforced by public authorities. On the other hand, the legal apprehension of secret pieces of information should be considered as falling within the realm of immaterial goods regulation aiming to solve the deficit of marketability of this type of good. This might call - after conducting a careful policy trade-off - for the establishment of relative (i.e. inter partes) subjective rights.

This book discusses the philosophical work of Decio Krause. Non-individuality, as a new metaphysical category, was thought to be strongly supported by quantum mechanics. No one did more to promote this idea than the Brazilian philosopher Decio Krause, whose works on the metaphysics and logic of non-individuality are now widely regarded as part of the consolidated literature on the subject. This volume brings together chapters elaborating on the ideas put forward and defended by Krause, developing them in many different directions, commenting on aspects not completely developed so far, and, more importantly, critically addressing their current formulations and defenses by Krause himself. Who carries the burden of proof in analytic philosophical debates, and how can this burden be satisfied? As it turns out, the answer to this joint question yields a fundamental challenge to the very conduct of metaphysics in analytic philosophy.

Empirical research presented in this book indicates that the vastly predominant goal pursued in analytic philosophical dialogues lies not in discovering truths or generating knowledge, but merely in prevailing over one's opponents. Given this goal, the book examines how most effectively to allocate and discharge the burden of proof. It focuses on premises that must prudently be avoided because a burden of proof on them could never be satisfied, and in particular discusses unsupportable bridge premises across inference barriers, like Hume's barrier between 'is' and 'ought', or the barrier between the content of our talk or thought, and the world beyond such content.

Employing this content/world barrier for a critical assessment of mainstream analytic philosophical methods, this book argues that we must prudently avoid invoking intuitions or other content of thought or talk in support of claims about the world beyond content, that is, metaphysically significant claims. Yet as content-located evidence is practically indispensable to metaphysical debates throughout analytic philosophy, from ethics to the philosophy of mathematics, this book reaches the startling conclusion that all such metaphysical debates must, prudently, be terminated.

This volume brings together a diverse set of scholars to address the long theoretical, conceptual and political debate on the interpretation of "actually existing" socialism in the Soviet Union and Eastern Europe. While the major paradigms - totalitarianism, neo-totalitarianism, revisionism, post-revisionism, modernization, and the world-system analysis - are well known in the Western (English-language) literature, the concept of state socialism, which has strong theoretical roots in Hungary (going back to the works of Gyoergy Lukacs and Istvan Meszaros) received less international attention. This book contributes to a productive discussion about viable alternatives to capitalism by introducing and theoretically elaborating on the concept and practice of state socialism, highlighting the historical significance of Hungary's experiment with the "new economic mechanism" of 1968. It generates a common point of reference for various generations of anti-systemic thinkers, scholars, and activists to move beyond Cold War simplifications and ideological divides, and contributes to the discussion about anti-capitalist alternatives, which are relevant today for the global left.
