This Commentary includes an analysis of each article's drafting history, alongside a contextualisation of its provisions with other anti-trafficking standards and a discussion of the core issues of interpretation. The Commentary also presents the first full exploration of the findings of the Convention's monitoring body, the Group of Experts on Action against Trafficking in Human Beings (GRETA), providing a better understanding of the practical implications and challenges in relation to the Convention's standards.
Practitioners in the field of anti-trafficking, including lawyers, law enforcement agencies and providers of victim support services will find the Commentary's concise analysis invaluable. It will also prove useful to researchers and students of human rights law, as well as to policymakers looking for guidance concerning obligations stemming from the Convention.

This book analyzes human rights and crime prevention challenges from the perspective of the 1948 Universal Declaration of Human Rights and the 2030 United Nations Sustainable Development Agenda, in particular its goal 16 on promoting peaceful, inclusive and just societies, the creation and development of which depend on the interplay between various secular and non-secular (f)actors. The book reflects on the implementation of these two legal instruments from a "back to the future" standpoint, that is, drawing on the wisdom of contributors to the 2030 Agenda from the past and present in order to offer a constructive inter-disciplinary and intergenerational approach. The book's intended readership includes academics and educationists, criminal justice practitioners and experts, diplomats, spiritual leaders and non-governmental actors; its goal is to encourage them to pursue a socially and human rights oriented drive for "larger freedom," which is currently jeopardized by adverse political currents.

The Universal Declaration of Human Rights (UDHR) is the best gift of the United Nations and its main human rights organ, the Human Rights Commission to "We, the Peoples of the World". But that powerful instrument is often rendered powerless by the behaviour of individuals running the institutions and the states, arguably the most powerful institution conceptualised by human mind so far. In the process, the UN comes under serious criticism and its most important organ which helped give the UDHR was dissolved for "failing to live up to its ideals". Ironically, the same states and their representatives most instrumental in creating the UN institutions, including the Human Rights Commission first but later vilifying it and leading the campaign for its replacement by the Human Rights Council are now once again attacking it as "hypocritical and self-serving organisation that makes a mockery of human rights" and the most powerful member state feels compelled to walk out of the Council. Where does the world, the UN and "we the peoples" stand in the search for greater freedom from want and fear, better enjoyment of dignity and rights?
Travelling through an extraordinary journey of life, academic pursuits and expeditions of professional and diplomatic mountain climbing, including the Chairmanship of the 56th Session of the UN Commission on Human Rights and its 5th Special Session on the Human Rights of the Palestinian People in the Occupied Palestine Territories, Shambhu Ram Simkhada presents a scholarly, diplomatic, advocate and defender perspectives on the contemporary state of human rights and human wrongs in the scale of his own human conscience.

This book provides a comprehensive human rights analysis of key areas of law affecting older persons, including legal capacity; elder abuse; accommodation and aged care; healthcare; employment; financial security, retirement, and estate planning; and social and cultural participation. The research identifies individual autonomy and participation in decision-making as fundamental to a human rights-based approach to elder law. The book argues that a paradigm shift must occur away from traditional medical and charity-based understandings of 'old age' to instead acknowledge older persons as active holders of enforceable rights. The book argues that a Convention on the Rights of Older Persons is an essential tool in achieving this, but that even without a dedicated treaty there is much to be gained from a human rights-based approach. Significantly, because the issues arising in 'old age' are often the culmination of experiences occurring throughout the life course, a human rights-based approach to elder law must begin with a commitment to human rights for people of all ages.

Young Refugees and Forced Displacement is about young Syrian and Iraqi refugees navigating the complex realities of forced displacement in Beirut. It is based on a British Academy funded two-year project with 51 displaced youths aged 8 to 17 and under the care of three local humanitarian organisations. Focus groups, interviews and innovative arts-based methods were used to learn about their everyday lives. At the end of the project, we coproduced with them a public mural, allowing unexpected epistemological and methodological reflections on researching refugees and the "right to opacity."
Families and friendships, humanitarian caregiving, racism, discrimination and everyday decencies and civilities make up the stuff of their ordinary, everyday encounters within refugeedom, defining both its sharper edges and its more inadvertent and quietly political ones. Thus, refugeedom, as we conceive it, includes "the humanitarian condition" but goes a little beyond it, to become also a human condition of political alterity. In navigating refugeedom, the young Syrians and Iraqis become sophisticated political and moral actors, using emotional reflexivity as they engage layered subjectivities to define the terms of their own forced displacement. This book will be of interest to policymakers, humanitarian organisations, social science scholars and students working on refugees, displacement, humanitarianism, intimacies and emotions, racism and discrimination. It may also be of interest to displaced youth.

Examining the relationship between humanitarianism, human rights, and security in the governance of borders and migration, this book analyses the case of the European Border and Coast Guard Agency (Frontex), challenging the common assumption that humanitarianism and human rights provide a critical basis for countering securitisation.
Arguing that these are not three opposing discourses and modes of governing, the author contributes to a deeper understanding of their connections and combined effects in border governance. Drawing on ethnographic fieldwork, interviews, and document analysis, the book offers three perspectives on Frontex's changing relationship to humanitarianism and human rights. In doing so, it provides a multifaceted account of Frontex and its gradual appropriation of what are often considered pro-migrant discourses. Combining organisational sociology with a Foucauldian analysis, the book speaks to ongoing debates on continuity and change in the security field and provides insights into studying security organisations more generally.
Drawing on insights from Critical Migration and Border Studies, Critical Security Studies, Critical Humanitarianism and Human Rights Studies, and Organisational Sociology, the book will generate interest to multiple disciplines, including Sociology, International Relations, Politics, Anthropology, European Studies, and Geography.

Elgar Research Agendas outline the future of research in a given area. Leading scholars are given the space to explore their subject in provocative ways, and map out the potential directions of travel. They are relevant but also visionary.
This Research Agenda maps thought-provoking research trends for the next generation of interdisciplinary human rights scholars in this particularly troubled time. It charts the historic trajectory of scholarship on the international rights regime, looking ahead to emerging areas of inquiry and suggesting alternative methods and perspectives for studying the pursuit of human dignity.
Chapters written by international experts cover a broad range of topics including humanitarianism, transitional justice, economic rights, academic freedom, women's rights, environmental justice, and business responsibility for human rights. The book highlights the importance of contemporary research agendas for human rights being centred on questions of governance and fulfilment, shifting responsibilities, rights interdependence and global inequality.
This is a critical read for students and scholars of human rights law, politics and international relations. The strong forward-looking agenda and coverage of a large number of fields within human rights studies will be helpful for advanced students looking for new areas of study for research projects.

This book takes a holistic approach by capturing the various perspectives and viewpoints concerning the theory and practice of Human Rights Journalism. Firstly, this book helps fill the epistemological vacuum present in Human Rights Journalism by proposing 'pragmatic objectivity' within the critical constructivist epistemology. Secondly, it defines the Human Rights Journalism-Responsibility to Protect nexus by identifying five key elements. Thirdly, it proposes a Human Rights Journalism-Responsibility to Protect conceptual model, which illustrates how an embedded human rights focussed media strategy can be designed. Fourthly, this book proposes two novel quantitative analysis tools called the 'Framing Matrix' and the 'Multimodal Discourse Analysis Matrix' that are equipped to deal with a big sample size over a long period of time. These tools are used to examine the practice of Human Rights Journalism and the typology of news stories of distant sufferings. Finally, it providesa scientific explanation for those in search of the answer to why one of the worst humanitarian crises in the world, which took place in Sri Lanka in 2009, did not create any global compassion or garner attention.

This book draws international attention to the autonomy of the child accompanying incarcerated mothers, and those they leave behind in the community, despite being dependent on the convicted caregiver.
Adopting a child rights perspective, the study explores how courts could go about sentencing mothers of young children for the commission of criminal offences, whilst protecting the rights of the child as envisaged under the United Nations Convention on the Rights of the Child (UNCRC). Drawing on the author's experience as a sentencer in the Kenyan court and with reference to domestic, regional and international law, the book argues that children's rights are presently left in abeyance when their mothers are sentenced to imprisonment, and that greater efforts should be made to recognize and give effect to the child's existence as an autonomous equal holder of human rights, despite being dependent on the convicted caregiver. It explores the application of precedence as well as the court's discretion in view of the dependent child, and concludes that policy reform in this respect calls for change in attitude and approach on women and children's issues. Observing that internationally, most women imprisoned with their children fall beneath the custodial threshold set by law, the research examines how current sentencing practices could be reformed, and suggests harnessing the Power of Mercy Committee, the Sentencing Guidelines and progressive practices from developed countries in protecting the child's rights by imposing non-custodial sentences for the offending mothers. It is concluded that in all jurisdictions, strict accountability for the dependent child should be situated with the judiciary, and that the same should be pronounced as a mandatory legal requirement.
The book will be a valuable resource for academic, researchers and policy-makers working in the area of international children's rights law and criminal law.

This book describes the potential and challenges of cosmopolitanism from a philosophical and historical point of view. Through the prism of cosmopolitanism, this book considers how the recent surge in migration is affecting our current reality, while also taking stock of the contemporary potential of cosmopolitan ideas. It considers and compares the significance of religion and culture for the wider societal acceptance or rejection of refugees. Moreover, the book examines the European Court of Human Rights jurisprudence on immigration policies, non-refoulement, humanitarian law and gender. It presents empirically based research of a quantitative, qualitative and comparative nature regarding the determinants of attitudes towards cosmopolitanism and more generally concerning public opinion on migration issues, and reflects on conceptions of and attitudes towards citizenship, while also imagining new forms of citizenship. This book serves as a comprehensive overview and resource for migration scholars from the social sciences and the humanities, as well as students and other stakeholders in the fields of migration and human rights.

This book presents a creative synthesis of two ostensibly disparate fields of law - arbitration and human rights. More specifically, it focuses on various legislative approaches to excluding the annulment of arbitral awards (setting-aside proceedings) at the seat of arbitration and evaluates the compatibility of such approaches with the European Convention on Human Rights (ECHR), in particular the right to a fair trial under Article 6(1).
The book first assesses the applicability and impact of the ECHR, in particular Article 6(1), on international commercial arbitration. It then analyses a number of legislative approaches to excluding setting-aside proceedings, focusing on two synergetic phenomena - exclusion agreements and the total lack of setting-aside proceedings in national arbitration law. Lastly, the book investigates to what extent the lack of setting-aside proceedings in national arbitration law may lead to a violation of arbitrating parties' right to a fair trial under Article 6(1), and puts forward certain de lege ferenda recommendations on how to best approach the regulation of setting-aside proceedings in national arbitration law from the standpoint of compliance with the ECHR.
